J Tapley Ronald Mitchell wants to build four townhome type units at 58 South 300 West. They will be located behind the existing home on that lot.

Each of the four townhomes would contain three bedrooms and one and one-half bathrooms and would include one covered parking per unit for the residents. All four units are proposed as rental housing held in single ownership.

This property is zoned Mixed Use and located in the Downtown area which has available residential density. However, recent amendments to the Development Code require 30 percent of the housing to be platted for individual ownership and that 50 percent of the finished interior floor area within the development have non-residential uses. Without an amendment to the Code or a Development Agreement, the currently proposed layout with only residential uses would not meet Code.
