The Planning Division is proposing a Development Code Amendment to Chapter 37 of the Development Code. Specifically, we are proposing to change the exception requirement for the maximum setback when a module of parking is allowed.

Currently, the State Highway Design Standard District and the General Nonresidential Design Standard District allows for a module of parking between the building and the street for certain uses. However, the maximum setback in both of these districts is 50-feet, and exceeding the maximum setback requires an exception from the Planning Commission. In very few cases can a building that has a module of parking have a setback that is under 50-feet, so it seems conflicting to require an applicant to ask for an exception to the code when we allow a module of parking. This amendment also cleans up language that calls to other sections of the code that are not relevant to this exception.
